In 1896, the Supreme Court in America had passed a judgment that established the basis for segregation in public schools. The court's decision was that it was legal and fair to separate students based on their race and color as long as the education given was equal.
However, we all know that education based on race and color is never equal.
In 1954, a landmark decision by the US Supreme Court nullified the 1896 ruling. It outlawed racial segregation in public schools; and a new era was ushered in where the nation saw desegregation of public schools right from elementary schools to college.
And now, there are two cases in the US Supreme Court that have challenged the public school board policies in Seattle and Louisville. The Bush Administration has publicly agreed with parents who brought about the lawsuits that want desegregation in schools in those districts.
These two lawsuits claim that desegregation although well-intentioned is not constitutional. For desegregation policies to be legal, the policies should be based on persuasive good reason and the lawsuits claim that there is no persuasive good reason in Louisville and Seattle school district area.
If the Supreme Court decides in favor of the parents, nearly 400 school districts in 17 states will be affected.
It is sad to know that the Bush Administration has supported many similar lawsuits publicly which are looking to eliminate federal ordered racial equity in business. In addition, a Harvard University's project on Civil Rights has found that public schools across America have been resegregating over last century, and segregation exists in district, state, regional and national levels. In addition, the project found that white students tend to attend public schools that are 80 percent white.
The trend among white parents is frightening for modern America. Parents are sending away their to private schools and now minority enrollment in public schools is 40 percent, which is nearly twice the number of minority students compared to 1960s.
